“Better Way to Fly Training Module”
Terms & Conditions
The “Better Way to Fly Training Module” (a “Trade Incentive Program”) is sponsored by Air New Zealand Limited (“Sponsor”). Offer void where prohibited.
1. HOW TO ENTER:
Agents who complete the 'Better Way to Fly' training module(s) between September 25 and November 13, 2017 will be entered into a random draw for one of sixteen (16) gift cards. Here is how to enter:
To enter, visit either the U.S. Air New Zealand Trade Website or the Canadian Air New Zealand Trade Website (the “Site”) at www.airnztravelagent.com/training or http://ca.airnztravelagent.com/training and complete the 'Better Way to Fly' training module(s).
The number of entries allowed per travel agent is one per completed module. In the event of a dispute as to the identity of the entrant, the entrant will be deemed to be the individual who is the registered holder of the e-mail account. Sponsor will not verify receipt of entries. Automated entries, including without limitation, auto-remailers, are prohibited, and any use of such automated devices will result in disqualification. Incomplete entries will be voided. All entries become the property of Sponsor and will not be returned. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. Sponsor is not responsible for incorrect or inaccurate entry of information by entrants; lost entries or transmissions; interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions of the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to entrants’ systems.
The Trade Incentive Program is open to any retail travel agent who is:
- United States Entry: United States entry is only open to individuals who are: (i) a legal resident of the United States, excluding Rhode Island; (ii) twenty-one (21) years of age or older as of the date of entry and has internet access and a current email account; (iii) not an employee of Air New Zealand Limited or any of its parent, affiliate, subsidiary, or any advertising and promotion agencies; (iv) not an immediate family member or any other person living in the same household of such an individual in (iii) above; and (v) currently employed as:
- a retail travel agent by an IATA/ARC appointed Travel Agency in the US and listed in the IATA/ARC registry at the time of travel; or
- an OSSN agent in the US with a valid TRUE number at the time of travel; or
- a CLIA Member Travel Agency in the US with a valid CLIA Agency number at the time of travel; or
- an active Aussie Specialist (verifiable by Tourism Australia); or active New Zealand Specialist; or
- a consortia member agency (verifiable by consortia)
2 Canada Entry: Canada entry is only open to individuals who are: (i) a legal resident of, and currently resides in Canada (residents of Quebec are not eligible); (ii) the age of majority in their province of residence as of the date of entry and who has internet access and a valid email account; (iii) Void in the Province of Quebec and where prohibited by law; (iv) is not an employee of Air New Zealand Limited or any of its parent, affiliate, subsidiary, or any advertising and promotion agencies; (iv) not an immediate family member or any other person living in the same household of such an individual in (iii) above; and (v) currently employed as:
- a retail travel agent by an IATA appointed Travel Agency in Canada and listed in the IATA registry at the time of travel; or
- a CLIA Member Travel Agency in Canada with a valid CLIA Agency number at the time of travel; or
- an active Aussie Specialist (verifiable by Tourism Australia); or
- a consortia member agency (verifiable by consortia)
Void where taxed, restricted, or otherwise prohibited by law. This promotion is intended for viewing in the United States and Canada and shall only be construed and evaluated according to United States law. You are not authorized to participate in the Trade Incentive Program if you are not located in the United States or Canada.
3. PRIZE DETAILS:
There are sixteen (16) prizes to be won. Eight (8) are available for US agents and eight (8) are available to Canadian agents. Each prize winner will receive:
The Approximate Retail Value (“ARV”) of each Prize is USD/CAD $25.00. All prizes claimed will be awarded. Sponsor reserves the right, in its sole discretion, to substitute and or modify the prize with a prize of equal or greater value with immediate effect at any time prior to the closing date of the Trade Incentive Program by advertising that fact. Only one (1) prize is permitted per family or household.
4. WINNER SELECTION:
Winning agents will be selected at random from the total group of entries. One winner from the US and one from Canada will be selected each week, for 8 weeks, on the dates as follows:
- September 29, 2017
- October 6, 2017
- October 13, 2017
- October 20, 2017
- October 27, 2017
- November 4, 2017
- November 11, 2017
- November 17, 2017
All decisions in all matters relating to this Trade Incentive Program made by Sponsor are final. Odds of winning depend solely on the total number of valid entries received. Winner will be notified by e-mail. If Sponsor, using commercially reasonable efforts, is unable to contact the potential winner within ten (10) business days from the first contact attempt, or if a potential winner has not, or does not comply with these Terms and Conditions, then such person shall be disqualified and an alternate winner may be selected.
5. GENERAL RULES & CONDITIONS
By participating in this Trade Incentive Program, entrants agree to be bound by these Terms and Conditions. Each entrant acknowledges that any information provided by entrant may be disclosed to Sponsor(s), and that Sponsor(s) may send marketing communications to entrants in accordance with each entrant’s “opt-in” selection. Winner gives Sponsor the right to use winner’s name, voice, picture, portrait and likeness for advertising and promotion purposes without further compensation, where permitted by law. These Terms and Conditions and all matters related to the Trade Incentive Program will be governed by the laws of the State of California, without regard to its conflict of laws principles.
6. LIMITATION OF LIABILITY:
SPONSOR, AND ITS PARENT, SUBSIDIARIES, AFFILIATES, DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, ADVERTISING AND PROMOTION AGENCIES INVOLVED IN THIS TRADE INCENTIVE PROGRAM SHALL HAVE NO LIABILITY AND SHALL BE HELD HARMLESS BY ENTRANT FOR ANY DAMAGE, LOSS OR LIABILITY TO PERSON OR PROPERTY, DUE IN WHOLE OR IN PART, DIRECLTY OR INDIRECLTY, BY REASON OF ENTERING THE TRADE INCENTIVE PROGRAM, THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO AND FROM ANY PRIZE-RELATED ACTIVITY. Any and all claims, judgements and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Trade Incentive Program, but in no event, attorney’s fees. Sponsor and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the Trade Incentive Program or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the Trade Incentive Program.
If for any reason the Trade Incentive Program is not capable of running as planned including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Trade Incentive Program, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Trade Incentive Program and/or prizes. In such event, Sponsor may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor further reserves the right to disqualify any individual who tampers with or in any way corrupts the entry process. Sponsor may prohibit an entrant from participating in the Trade Incentive Program or winning a prize if, in sponsor’s sole discretion, Sponsor determines that said entrant is attempting to undermine the legitimate operation of the Trade Incentive Program by cheating, hacking, deception, or any unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE TRADE INCENTIVE PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT OR ANY OTHER INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
